A. General Provisions
Purpose of Policy.
This Enrollment Policy defines the rules, rights, and obligations governing how Students may apply for and participate in courses at Lingua Classica – Zabelina, Elena und Das, Tanmay Kumar GbR. It is designed to ensure transparency, consistency, and legal certainty in the administration of all enrollments. The policy supplements the General Terms and Conditions (AGB), which remain the primary binding document. All Students are expected to familiarize themselves with both this Enrollment Policy and the AGB prior to submitting an application. By confirming their enrollment, Students agree to be bound by the provisions of this policy without reservation. Any exceptions or deviations are only valid if agreed to in writing by Lingua Classica.
Relation to AGB.
The provisions of this Enrollment Policy operate in conjunction with the AGB. Where conflicts or inconsistencies arise, the AGB shall take precedence, unless otherwise required by mandatory statutory law. This ensures that all Students receive equal protection under German civil law, particularly the Bürgerliches Gesetzbuch (BGB). References to specific AGB sections are provided throughout this document for cross-referencing purposes, making the contractual framework transparent. Students are therefore encouraged to consult the AGB whenever uncertainty arises, as this Enrollment Policy does not replace but rather complements it. By integrating both sets of rules, Lingua Classica ensures that Students benefit from a comprehensive and coherent contractual structure.
Scope of Enrollment and Definition of Course Units.
Enrollments at Lingua Classica are concluded strictly per course duration or per defined teaching unit (TU), as specified in the course description and enrollment confirmation. Each confirmed enrollment constitutes a separate contractual entity under § 145 ff. BGB, limited exclusively to the scheduled course period communicated at the time of booking.
The designation of a language level (e.g., A1, A2, B1, B2, C1) serves solely as an academic classification for internal organization and does not represent a distinct contractual segment or service division. Bookings that include multiple consecutive levels (e.g., A1–B1) are treated as a single contractual engagement for the agreed duration.
Accordingly, cancellations, withdrawals, or refund claims related to individual levels within a continuous course structure are excluded once the first course period has commenced. This ensures contractual transparency, prevents the artificial fragmentation of course agreements, and aligns with the principles of fairness and legal certainty under §§ 305c and 307 BGB.
Lingua Classica maintains the right to assign, merge, or restructure class groups by pedagogical discretion, provided that the overall duration and agreed service scope remain unaffected.

B. Enrollment Procedure
Application and Submission.
Enrollment applications may be submitted through the official online form provided on linguaclassica.de or by completing a physical form available at the school office. The act of submitting an application constitutes a legally binding offer under § 145 BGB, which the Student cannot unilaterally revoke without following statutory procedures. Lingua Classica reviews each application for accuracy, completeness, and compliance with admission requirements before proceeding to confirmation. Applications that contain false or misleading information may be rejected outright, and the Student may be held liable for any resulting damages. Enrollment is not guaranteed until confirmation is issued by Lingua Classica in writing. Only then does a contractual relationship between the Student and Lingua Classica come into legal effect.
Contract Formation.
The enrollment contract is concluded once Lingua Classica formally accepts the Student’s binding offer by issuing a written confirmation of enrollment. This confirmation is typically sent via email but may also be delivered in writing at the school premises. The statutory withdrawal period of fourteen (14) days commences upon the day the Student receives the enrollment confirmation email together with the attached Widerrufsbelehrung. This period is independent of any payment activity. No legal entitlement to participation exists until such confirmation is received. Importantly, confirmation is conditional upon receipt of the required advance booking payment or, where applicable, full tuition fees. If payment is not received within the stipulated deadlines, Lingua Classica reserves the right to rescind the contract without liability. Students are strongly advised to retain all communications and payment receipts, as these documents may serve as evidence of contractual obligations in case of dispute.
Special Documents for Visa-Seeking Students.
Students applying for visas are subject to additional documentation requirements. These include, but are not limited to, copies of valid passports, proof of financial means, residence permits (if already in Germany), and any supporting documents requested by Lingua Classica. Enrollment confirmations intended for use in visa applications will only be issued after full compliance with all documentation and payment requirements. Lingua Classica expressly disclaims liability if a Student fails to provide accurate or complete documents, resulting in visa denial. In such cases, any refund claims are governed exclusively by Section F of the AGB (Cancellation Policy). By applying as a visa-seeking Student, the applicant acknowledges these additional obligations and accepts the associated risks.

D. Deferrals, Postponements, and Re-Enrollment
Deferrals Before Course Start.
Students may submit a written request to defer their enrollment to a later course date. Such requests must be made no later than 14 calendar days before the original course start date. Approval is at the sole discretion of Lingua Classica and depends on availability and administrative capacity. If approved, any payments already made will be credited toward the deferred course, but refunds are expressly excluded unless otherwise agreed in writing. Deferrals requested less than 14 days before the scheduled start are generally not accepted, except in cases of proven force majeure. Students must be aware that deferrals are a privilege and not a right, and repeated requests may be refused to maintain fairness and operational planning.
Postponement by Lingua Classica.
Lingua Classica reserves the right to postpone courses if the minimum number of participants, as defined in Section C, Clause 1 of our Terms of Service (AGB), is not reached or if unforeseen organizational circumstances occur. In such cases, Students are given the choice to transfer payments to the new start date or to request a refund within fourteen (14) calendar days, pursuant to § 346 BGB. Refunds are processed without undue delay but do not include compensation for incidental expenses such as travel or accommodation. Lingua Classica is not liable for damages caused by postponements, except in cases of gross negligence or willful misconduct. Students are notified of any postponements promptly by email or in writing. This ensures transparency and provides Students with sufficient time to make alternative arrangements.
Re-Enrollment After Withdrawal.
Students who withdraw from a course after enrollment and later seek to re-enroll must submit a new application. Re-enrollment is subject to availability and may be subject to additional administrative fees, which will be communicated in writing before acceptance. Payments already made for the previous enrollment cannot be automatically transferred unless expressly agreed by Lingua Classica. Re-enrollment is considered a new contractual relationship, with all rights and obligations applying anew. Students who repeatedly withdraw and reapply may be denied admission to maintain the integrity and predictability of course planning. This provision ensures fairness and prevents misuse of the enrollment system.

E. Withdrawal and Termination.
Statutory Right of Withdrawal.
Students who enroll online or off-premises enjoy a statutory 14-day right of withdrawal under §§ 355, 356 BGB. This right allows Students to cancel their enrollment without giving reasons within fourteen (14) days of contract conclusion. The statutory withdrawal period of fourteen (14) days commences upon the day the Student receives the enrollment confirmation email together with the attached Widerrufsbelehrung. Withdrawal must be declared in writing (e.g., by email or post) and must be submitted within the prescribed period to be effective. Lingua Classica will confirm receipt of such withdrawals in writing. Refunds are processed according to statutory requirements, with any deductions clearly explained. Once the withdrawal period expires, Students are bound exclusively by the contractual cancellation rules set out in Section F of our Terms of Service (AGB).
Termination by the Student.
Outside the statutory withdrawal period, termination is only possible in accordance with Section F of our Terms of Service (AGB, Cancellation Policy). Students remain fully obligated to pay fees as agreed, even in cases of non-attendance, unless valid termination grounds are provided. Personal reasons such as illness, relocation, or scheduling conflicts do not automatically constitute grounds for extraordinary termination. Lingua Classica may, at its sole discretion, consider exceptions upon submission of sufficient documentation (e.g., medical certificates). Such exceptions, however, do not create a legal precedent or entitlement for future cases. This ensures that obligations remain predictable and enforceable while leaving room for compassionate exceptions.
Termination by Lingua Classica.
Lingua Classica reserves the right to terminate enrollment contracts for cause pursuant to § 314 BGB. Grounds for termination include, but are not limited to, repeated non-payment, severe breaches of school regulations, or conduct that significantly disrupts the learning environment. In such cases, Lingua Classica will issue a written termination notice specifying the grounds for dismissal. Students terminated for cause are not entitled to refunds, and outstanding payment obligations remain in effect. Where termination is due to misconduct, Lingua Classica reserves the right to pursue damages under civil law. This protects the learning environment and ensures accountability for serious violations.

F. Final Provisions
Language of Contract.
The contractual language is German. English translations are provided solely for convenience and do not alter the binding effect of the German version. In case of conflict, only the German text is legally valid. This ensures consistency in interpretation and avoids disputes arising from translation errors. Students enrolling from abroad must take this into account when reviewing contractual documents.
Jurisdiction and Applicable Law.
This policy is governed by German law. Place of jurisdiction for disputes arising from or in connection with this policy is Bielefeld, provided this does not infringe upon mandatory consumer protection provisions. This clause ensures predictability and legal certainty in the event of conflict. Students residing within the European Union retain their statutory consumer rights under EU law. Any attempt to waive such protections shall be deemed void.
Reference to our Terms of Service (AGB).
This Enrollment Policy forms an integral part of the contractual framework of Lingua Classica. It must be read in conjunction with the AGB, which provides more detailed provisions on payment, withdrawal, cancellation, and liability. References to specific AGB sections are provided throughout this document for clarity. Students should not interpret this policy in isolation but as part of the overall contractual system. By confirming enrollment, Students acknowledge that they have read, understood, and agreed to both documents in their entirety.
Please note: This Enrollment Policy is intended as a practical guide. The binding contractual terms, including payment obligations, cancellation rights, and refund policies, are set out in our Terms of Service (AGB). In the event of discrepancies, the AGB shall prevail.
