General Information

  1. Provider Information

    The language courses and related services are offered by Lingua Classica – Zabelina, Elena und Das, Tanmay Kumar GbR, Bahnhofstraße 42, 33602 Bielefeld, Germany. All correspondence relating to contracts, enrollment, and payment must be directed to this address or to the official email address info@linguaclassica.de. The GbR is jointly represented by the named partners, who are equally responsible for the proper fulfillment of contractual obligations. Students are encouraged to retain this information for their records, as it constitutes the formal provider identification required under § 5 TMG (Telemediengesetz).

  2. VAT Exemption

    All course fees are exempt from VAT under § 4 Nr. 21 a) bb)UStG, issued by the Bezirksregierung Detmold (District Government of Detmold), the competent regional authority in North Rhine-Westphalia.

  3. Scope of Application

    These Terms and Conditions (AGB) apply to all contracts between Lingua Classica and its students (“Student”), whether concluded online or in person. They govern participation in all language courses, private lessons, exam preparation sessions, and related services, unless otherwise explicitly agreed upon in writing. By enrolling, the Student accepts that these Terms form an integral part of the contractual agreement. Any alternative terms proposed by the Student are excluded unless Lingua Classica has expressly agreed to them in writing.

  4. Contractual Language (Please refer to Section G, clause 2)

    The contractual language for all agreements with Lingua Classica is German. Translations into English or other languages are provided exclusively for convenience and information purposes. In the event of discrepancies between the German version and any translation, the German version shall prevail as legally binding. Students are therefore advised to refer to the German version in case of doubt, in order to ensure their full understanding of rights and obligations under this contract.

  5. Definition of “Course”

    For the purpose of these Terms of Service, a “Course” refers to a distinct and self-contained contractual service unit that is booked for a specific duration or a defined number of teaching units (Unterrichtseinheiten). Each course constitutes an independent service contract (Dienstvertrag as defined in § 611a BGB) concluded between the student and Lingua Classica – Zabelina, Elena und Das, Tanmay Kumar GbR.

    A Course shall not be understood as one entire language level (e.g. A1, A2, B1, B2, C1) or as a series of consecutive modules (A2.1, A2.2). Each booking—whether for an intensive, evening, private, or exam preparation course—represents a separate contractual performance obligation within the meaning of §§ 305 to 307 BGB and § 611a BGB.

    Accordingly, the booking applies only to the specific course duration or the specific number of teaching units agreed upon, and not to an entire level progression. Completion of one Language Level (for example, A1) does not create a right to cancel, modify, or withdraw from another Language Level (for example, A2 or B1) outside the statutory or contractually defined withdrawal or cancellation periods.

  6. Conclusion of Contract (Please refer to Section G, clause 2)

    a) Online Enrollment: By completing the online enrollment form and confirming the order using the legally required button “Zahlungspflichtig buchen / Confirm Enrollment – Payment Required,” the Student submits a binding contractual offer (§ 145 BGB). The contract comes into effect only once Lingua Classica issues a written confirmation via email.

    b) On-Site Enrollment: When enrolling in person at the school, the Student submits a binding offer by signing the physical enrollment form. The contract is concluded upon countersignature or written confirmation by Lingua Classica. Both methods of enrollment are legally equivalent and binding.

  7. Applicable Law and Jurisdiction (Please refer to Section G, clause 1)

    All contracts are subject to German law, to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods (CISG). For Students who are merchants under German law, the place of jurisdiction is Bielefeld. For consumers, the statutory provisions regarding place of jurisdiction remain unaffected. Mandatory consumer protection rights, especially under EU law, continue to apply in all cases. This ensures that Students retain the minimum legal protections provided in their country of residence, even if German law is chosen.

  8. Force Majeure (Please refer to Section G, clause 3)

    Lingua Classica shall not be held liable for delays, cancellations, or changes to courses caused by circumstances beyond its reasonable control. Such events include but are not limited to natural disasters, pandemics, governmental restrictions, strikes, or major disruptions in essential infrastructure. In such cases, Lingua Classica reserves the right to reschedule, adapt, or temporarily suspend courses. Students will be informed promptly of any changes, and no claims for damages may be derived from such events, in accordance with § 275 BGB.

  9. Limitation of Liability (Please refer to Section G, clause 4)

    a) Lingua Classica accepts unlimited liability only in cases of intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit).

    b) In cases of simple negligence, liability is limited to breaches of essential contractual duties (Kardinalpflichten), and the liability is capped at the foreseeable, contract-typical damages.

    c) Liability for damages resulting from injury to life, body, or health remains unlimited and unaffected by the above limitations, in line with statutory provisions (§ 309 Nr. 7 BGB).

    d) Any further liability, particularly for consequential damages such as lost profits, is excluded unless otherwise required by law.

Important Terms & Policies

A. Refund Policy.

  1. General Principle of Non-Refundability

    Once a course has commenced, tuition fees are generally non-refundable, regardless of whether the Student attends classes in full, in part, or not at all. This principle is based on § 615 BGB, which provides that the obligation to pay remains even if the Student fails to utilize the agreed service. Exceptions apply only where explicitly stated in these Terms, in particular under Section F (Cancellation Policy). Statutory consumer rights, including the right of withdrawal (Widerrufsrecht) pursuant to §§ 312g, 355, and 356 BGB, remain unaffected. The statutory withdrawal period of fourteen (14) days begins on the day the contract is concluded. The conclusion of the contract occurs when the Student receives the enrollment confirmation email together with this Widerrufsbelehrung in text form (§ 355 Abs. 2 BGB). The commencement of the withdrawal period is not dependent on any payment being made. By enrolling, Students acknowledge that course fees secure their place in a class and cover the school’s teaching and administrative obligations, which cannot be reallocated once the course begins.

  2. Visa-Specific Refunds

    Enrollment documents are prepared primarily for immigration purposes and their preparation constitutes a contractual service. Within the 14-day statutory withdrawal period, the general right of withdrawal applies (see Section F.1). However, if a Student withdraws after visa documents have already been issued, Lingua Classica retains a flat administrative fee of €499 to cover the cost of document preparation, as allowed under § 346 BGB (compensation for services already provided). After the expiry of the statutory withdrawal period, refunds are only possible if a visa application is officially refused by the relevant embassy or consulate. In such cases, the original visa refusal letter must be submitted no later than ten (10) business days before the confirmed course start date. If the refusal letter is submitted in time, tuition fees will be refunded minus the €499 administrative fee. If proof of visa refusal is not provided, or is submitted late, tuition fees are strictly non-refundable.

  3. Non-Visa Cancellation after Withdrawal Period

    For Students not requiring visas, or for those who have already waived or exhausted their right of withdrawal, cancellation requests must be submitted in writing no later than fourteen (14) calendar days before the scheduled course start date. Cancellations received after this deadline or once the course has commenced do not entitle the Student to any refund or release from payment obligations, pursuant to § 615 BGB (continued obligation to pay despite non-attendance) and § 307 BGB (reasonable risk allocation). By enrolling, Students expressly accept this risk allocation, acknowledging that the school commits resources, reserves places, and organizes staff in reliance on confirmed enrollments.

  4. School-Initiated Cancellations

    If Lingua Classica cancels a course due to insufficient enrollment (fewer than four Students, see Section C.2), or due to other reasons that make performance impossible under § 275 BGB (e.g., force majeure, instructor illness without possibility of replacement), Students are entitled to a full refund of all fees already paid. The school may, however, retain a processing fee of up to €50 to cover administrative costs, as permitted by § 346 BGB. Students will be informed promptly in writing of such cancellations. No further claims for damages or compensation can be asserted beyond the refund, unless Lingua Classica has acted with gross negligence or intent.

B. Payment Policies.

  1. General Payment Terms

    All tuition fees are clearly displayed on the Lingua Classica website and are communicated in writing during the enrollment process. Students acknowledge that the prices listed on the website at the time of their enrollment apply to their course, unless a separate written agreement has been concluded. Intensive courses (A1–C1) are calculated either as a total fee or as monthly installments, depending on the chosen plan, while evening and private lessons are priced separately. Specialized courses, such as exam preparation or custom training, are subject to individually agreed fees that are confirmed in writing. All fees — whether shown as monthly installments or lump sums — represent the total legally binding contract value and must be settled according to the payment arrangements set forth in these Terms.

  2. Upfront Payment Policy

    Students are strongly encouraged to pay their entire course fee in advance, as this guarantees their seat in the course and avoids administrative complications. When upfront payment is chosen, the entire tuition must be received by Lingua Classica before the course start date, unless a different written arrangement has been expressly confirmed. Students who pay upfront in full may qualify for specific discounts (e.g., early bird discounts), but only if the payment reaches Lingua Classica within the specified deadlines. All upfront payments are legally binding and are generally non-refundable, except in cases where statutory withdrawal rights apply under §§ 312g, 355 BGB or in the exceptional circumstances outlined in Section F (Refund & Cancellation Policy). Students accept that once a course begins, their participation is binding and they remain fully liable for the agreed fee.

  3. Installment and Advance Payment Policy

    Installment payments are offered solely as a convenience to the Student and do not reduce or alter the obligation to pay the full agreed course fee (§ 611a BGB). Unless otherwise explicitly agreed in writing, the advance booking amount — usually equivalent to the first month’s tuition, but possibly higher as determined by Lingua Classica — is due immediately upon enrollment in order to secure the Student’s place. The first regular installment must be paid no later than three calendar days before the official start of the course, with all subsequent installments due on the 1st calendar day of each following month, payable in advance (§ 271 BGB). For Students who are applying for a visa from within Germany, a minimum of 50% of the total course fee must be paid upfront; the remaining balance may be settled either in monthly installments or in one lump sum at least three calendar days prior to the course start, as agreed with Lingua Classica. For Students applying for a visa from outside of Germany, installment payments are not available: such Students must pay 100% of the tuition fees in advance to confirm their enrollment and to meet the financial documentation requirements for their visa application. If a Student terminates attendance early without a valid statutory withdrawal under §§ 312g, 355 BGB, all outstanding installments for the remaining course period become immediately due and payable as a lump sum (§§ 280, 286 BGB). Lingua Classica reserves the right to suspend participation if any installment is more than 10 days overdue and to initiate legal enforcement or collection proceedings if the balance remains unpaid. By opting for installments, the Student explicitly acknowledges that discontinuation of attendance, non-issuance of a visa, or voluntary withdrawal does not discharge their contractual payment obligations unless Lingua Classica has expressly agreed otherwise in writing.

  4. Late Payment and Non-Payment Policy

    A payment is in default (Verzug) as soon as the agreed calendar due date passes without need for a reminder (§ 286 Abs. 2 Nr. 1 BGB), or—at the latest—30 days after the due date and receipt of an invoice if the consumer was informed of this consequence (§ 286 Abs. 3 BGB; this clause and our invoices contain that notice). From the onset of default, statutory default interest accrues at five percentage points above the base rate (§ 288 Abs. 1 BGB i.V.m. § 247 BGB), calculated on the open principal until receipt of full payment. In addition, we levy a reasonable processing fee of €15 per overdue installment to cover internal dunning/handling costs; the Student may prove that no or lower costs were incurred, in which case the fee is reduced accordingly (Schadensminderung; §§ 280, 286 BGB). Until all due amounts (principal, interest, and fees) are settled, Lingua Classica may withhold performance—i.e., deny participation in classes and access to materials—under the defence of unperformed contract (§ 320 BGB). If default persists beyond 30 calendar days, we may—after a written reminder setting a final grace period—terminate for cause (§ 314 BGB) and claim damages for non-performance, including making all remaining installments immediately due as per B.3 (Schadensersatz statt der Leistung; §§ 280, 281, 286 BGB). Should an account remain unpaid after 60 calendar days or following termination, we may engage a collection agency or legal counsel; the Student bears necessary and appropriate enforcement costs (e.g., bank chargeback fees (Rücklastschrift), collection and attorney fees under RVG) arising from default (§§ 280, 286 BGB). Payments are deemed received only when credited in full to our account; any transfer/processing costs or shortfalls are borne by the payer (§ 270 Abs. 1 BGB), and must be grossed-up so the invoiced amount is received net.

  5. Discounts and Promotions

    All discounts and promotional offers by Lingua Classica are granted on a voluntary basis and are non-transferable, unless explicitly stated otherwise in writing. Early bird discounts, referral bonuses, or other promotions are considered price reductions within the meaning of § 3 UWG (fair competition law) and must therefore be communicated clearly, truthfully, and in a transparent manner to avoid misleading students. Discounts are only valid if the conditions (e.g., timely payment, successful referral, specific course booking) are fully met by the Student; if the condition is later not fulfilled, Lingua Classica reserves the right to reclaim or offset the discounted portion (§ 812 BGB – unjust enrichment). Discounts cannot be combined unless expressly stated, and do not apply to installment payment plans unless explicitly permitted. Any promotional offer is always time-limited and may be withdrawn or modified at any time before enrollment is completed; once a Student has enrolled under a published discount, they retain the right to the granted reduction. The Student is not entitled to demand the continuation of past promotions or to claim damages if a promotion is withdrawn, provided that this is done in line with consumer protection rules (§§ 305b, 307 BGB on transparency and fairness of general terms).

  6. Communication of Policies

    Lingua Classica ensures that all payment and contract policies are communicated to Students in a clear, transparent, and legally binding manner in accordance with §§ 305b, 307 BGB. During online enrollment, the Student must actively confirm acceptance of the Terms of Service by checking a mandatory checkbox; pre-ticked boxes or implicit consent are not permitted under EU consumer law (Art. 8 Abs. 2 RL 2011/83/EU, implemented in §§ 312i, 312j BGB). In the case of on-site enrollment, Students confirm their acceptance by signing the physical enrollment form, which includes reference to these Terms. In both scenarios, the acceptance constitutes a legally binding declaration of consent that is stored for verification purposes in compliance with GDPR obligations (Art. 6 Abs. 1 lit. b DSGVO). Policies are made permanently available on the Lingua Classica website and are also attached to enrollment confirmations sent via email, ensuring that Students have access both before and after concluding the contract. Lingua Classica reserves the right to update these Terms in accordance with statutory requirements, and Students will be informed of such changes in writing if their ongoing contracts are affected.

C. Course Participation and Organization.

  1. Admission and Placement

    Enrollment becomes binding upon confirmation of the booking by Lingua Classica. Lingua Classica reserves the right to require a placement test or other suitable proof of language proficiency in order to determine the appropriate course level. Admission to a particular course level may be refused if the Student does not meet the applicable prerequisites, including required prior knowledge, language proficiency, or minimum age requirements. Where the Student does not meet the requirements for the requested course level, Lingua Classica may offer placement in another suitable course level, subject to availability. The Student has no entitlement to placement in a particular course level contrary to the result of the placement assessment or the applicable admission requirements. Any specific documents or evidence required for admission must be submitted within the period specified by Lingua Classica.

  2. Minimum Number of Participants

    Each group course requires a minimum of four (4) enrolled and confirmed Students in order to commence or continue. If the required minimum number of participants is not reached or subsequently falls below the minimum, Lingua Classica reserves the right, taking into account operational and pedagogical requirements, to postpone the commencement or continuation of the course, combine the course with another suitable group, reallocate Students to another suitable group, or cancel the course. Lingua Classica may also offer an alternative suitable course, course group, or starting date. Students will be informed of such organisational changes as early as reasonably possible. The combination of groups, reallocation to another suitable group, or a reasonable postponement of the course does not, by itself, constitute a cancellation of the contract and does not give rise to an entitlement to a refund, fee reduction, credit, replacement lessons, or other monetary compensation. If Lingua Classica ultimately cancels a course without providing a suitable alternative or subsequent opportunity to complete the booked course, course fees already paid for the part of the course that will not be provided will be refunded. No administrative fee will be deducted from such refund. Mandatory statutory rights remain unaffected.

  3. Public Holidays

    No regular classes are held on statutory public holidays applicable at the place of instruction. Public holidays are taken into account in the organization, scheduling, and calculation of group courses. Classes that do not take place because of a statutory public holiday will not be rescheduled or replaced and do not give rise to an entitlement to a refund, fee reduction, credit, extension of the course, replacement lessons, or other monetary compensation. Where necessary for organizational or pedagogical reasons, Lingua Classica may voluntarily offer replacement lessons or make alternative scheduling arrangements. Any such arrangement is made at the discretion of Lingua Classica and does not establish an entitlement to comparable arrangements in other cases. Students will be informed of the applicable course schedule and relevant non-teaching days through the academic calendar, course confirmation, website, or another suitable communication channel. Mandatory statutory rights remain unaffected.

  4. School Holidays and Scheduled Closures

    Lingua Classica determines its academic calendar, including school holidays, winter breaks, and other scheduled non-teaching periods. Such periods form part of the regular organisation of the academic year and are taken into account in the scheduling and calculation of course fees. Lingua Classica generally provides two full teaching weeks in December and two full teaching weeks in January. The remaining period may be designated as the annual winter break. A full teaching week means a Monday-to-Friday week excluding applicable statutory public holidays. The exact dates of the winter break and any other scheduled school closures are determined by Lingua Classica and published or communicated to Students in advance. Lingua Classica reserves the right to make reasonable adjustments to these dates where required for operational, organisational, staffing, or academic reasons. Scheduled school holidays, winter breaks, and other non-teaching periods forming part of the academic calendar do not constitute cancellation or interruption of the booked course and do not extend the contractual course duration. Students are not entitled, solely as a result of such scheduled non-teaching periods, to replacement lessons, additional teaching days, an extension of the course, a refund, fee reduction, credit, transfer of unused teaching time, or other monetary compensation. Lingua Classica may, at its discretion, provide additional lessons or make alternative scheduling arrangements. Any such voluntary arrangement does not establish an entitlement to equivalent arrangements in the same or future courses. Mandatory statutory rights remain unaffected.

  5. Course Groups and Allocation of Time Slots

    The allocation of Students to course groups and available time slots is determined by Lingua Classica. In making such allocations, Lingua Classica may take into account, in particular, the Student’s course level, participant numbers, group composition, course availability, teacher availability, and operational and pedagogical requirements. Students may communicate preferences regarding a particular course group, teacher, or time slot. Such preferences will be considered where reasonably possible but do not create an entitlement to a particular course group, teacher, or time slot, unless Lingua Classica has expressly confirmed the respective arrangement as a binding contractual commitment. Where a Student books a programme comprising multiple consecutive course levels or modules (for example A1, A2 and B1), any time slot allocated or confirmed for one particular level or module applies only to that level or module. It does not constitute a commitment or guarantee that any subsequent level or module will take place in, or be allocated to, the same time slot. Lingua Classica determines the time slot for each subsequent level or module separately according to the available course schedule and the organisational and pedagogical requirements existing at the relevant time. A Student who has booked several consecutive levels or modules therefore has no entitlement to continuation in the same time slot, course group, or with the same teacher. The allocation of a subsequent level or module to a different available time slot, course group, or teacher in accordance with this provision does not, by itself, constitute a cancellation, interruption, or modification of the booked course programme and does not entitle the Student to withdraw from the programme, suspend payment, or claim a refund, fee reduction, credit, replacement lessons, extension, damages, or other monetary compensation. Mandatory statutory rights remain unaffected.

  6. Academic Calendar and Adjustments to Scheduling

    Lingua Classica determines its academic calendar and reserves the right to make reasonable adjustments to course schedules and teaching arrangements where required for operational, organisational, pedagogical, staffing, technical, or other comparable reasons. Such adjustments may include, in particular, changes to course times, individual teaching days, course groups, teaching rooms or locations, teachers, and the temporary delivery of individual lessons or limited periods of instruction online. Lingua Classica may also combine or reorganise course groups, reschedule individual lessons or teaching days, or make other reasonable adjustments necessary for the proper organisation and continuation of teaching. The manner in which such organisational adjustments are implemented is determined by Lingua Classica, taking into account the circumstances of the individual case and the continued provision of the essential educational content of the booked course. Students will be informed of material scheduling or organisational changes as early as reasonably possible through email or another communication channel customarily used by Lingua Classica. A reasonable adjustment made in accordance with this provision does not constitute cancellation, interruption, or termination of the booked course and does not, by itself, entitle the Student to withdraw from the course, suspend or withhold payment, demand replacement lessons or an extension of the course, or claim a refund, fee reduction, credit, damages, or other monetary compensation. Lingua Classica may, at its discretion, provide replacement lessons, alternative teaching arrangements, or other accommodations. Any such voluntary measure does not establish an entitlement to the same or comparable arrangements in the same or future courses. Mandatory statutory rights remain unaffected.

  7. Attendance, Absence and Punctuality

    Students are expected to attend classes regularly and punctually and to comply with the attendance requirements applicable to their course. Absence, lateness, or non-attendance by the Student, regardless of the reason, does not suspend, reduce, or otherwise affect the Student’s contractual payment obligations and does not, by itself, entitle the Student to a refund, fee reduction, credit, replacement lesson, extension of the course, transfer of missed teaching time, or other monetary compensation. Missed lessons are generally considered forfeited and will not be individually rescheduled or repeated. Lingua Classica is not obliged to provide individual replacement lessons, teaching materials, recordings, or alternative instruction for lessons missed by the Student. Lingua Classica may, at its sole discretion and where operationally feasible, permit a Student to attend a suitable replacement lesson, temporarily join another appropriate group, or make another accommodation. Any such arrangement is voluntary, does not constitute an entitlement, and does not establish a precedent for the same or comparable accommodation in the future. Repeated or substantial absence, persistent lateness, or other attendance behaviour that materially disrupts the course or the learning progress of the group may result in appropriate organisational or disciplinary measures, including, where justified, reassignment to another group or exclusion from continued participation. Such measures do not, by themselves, release the Student from payment obligations already incurred or otherwise contractually due. Where a particular attendance rate is required for the issuance of a participation certificate, confirmation of attendance, visa-related documentation, or another document, Lingua Classica may refuse to issue such document or may state the Student’s actual attendance where the applicable attendance requirement has not been met. Mandatory statutory rights remain unaffected.

  8. Voluntary Interruption or Pause by the Student

    A Student who voluntarily interrupts, pauses, or temporarily discontinues participation in an ongoing course or course programme remains bound by the existing contract. A voluntary interruption or pause does not suspend, extend, terminate, or otherwise modify the contract or the Student’s contractual payment obligations, unless Lingua Classica expressly agrees otherwise. Course fees already paid will not be refunded or credited solely because the Student voluntarily interrupts or pauses participation. Any outstanding course fees remain payable in accordance with the contractual payment terms. The Student’s non-attendance during the period of interruption does not create an entitlement to replacement lessons, transfer of unused teaching time, a fee reduction, credit, extension of the course, or other monetary compensation. Lingua Classica is not obliged to reserve the Student’s previous place, course group, teacher, time slot, or course schedule during the period of interruption. A voluntary interruption does not automatically extend the originally scheduled course period or reserve a place in any subsequent course. If the Student wishes to resume participation after an interruption, Lingua Classica shall determine the Student’s placement according to the Student’s appropriate course level, the current course schedule, available capacity, participant numbers, group composition, teacher availability, and operational and pedagogical requirements. The Student has no entitlement to immediate resumption, to a particular resumption date, or to continuation in the same course group, with the same teacher, or in the same time slot. Where no suitable place is immediately available, the Student may be required to wait until the next suitable course or group becomes available. Such a waiting period resulting from the Student’s voluntary interruption does not constitute a cancellation, delay, or failure of performance by Lingua Classica and does not, by itself, entitle the Student to withdraw from the remaining course programme, suspend or withhold payment, or claim a refund, fee reduction, credit, damages, or other monetary compensation. Any exception, accommodation, deferral, alternative placement, or other arrangement granted by Lingua Classica in an individual case is voluntary unless expressly agreed otherwise and does not establish an entitlement to the same or comparable treatment in the same or future cases. Mandatory statutory rights remain unaffected.

  9. Course Materials and Intellectual Property

    Students are responsible for obtaining and bearing the costs of any textbooks, workbooks, digital resources, or other course materials designated as required for their course, unless Lingua Classica expressly states otherwise. Teaching materials, worksheets, exercises, presentations, digital content, recordings, course documents, and other educational resources provided or made available by Lingua Classica or its teaching staff are intended exclusively for the Student’s personal use in connection with the booked course, unless expressly stated otherwise. Students may not, without prior permission, reproduce, publish, distribute, sell, upload, forward, share, commercially exploit, make publicly accessible, or otherwise provide such materials to third parties where doing so would infringe intellectual property rights or contractual usage restrictions. Access to digital platforms, files, recordings, or other course resources may be limited to the duration of the relevant course and may be withdrawn after the course ends or where the Student is no longer entitled to participate. Lingua Classica reserves the right to restrict or withdraw access to school-provided materials and digital resources in cases of misuse or unauthorised distribution and may take appropriate action to protect its own intellectual property rights and those of third parties. Serious or repeated misuse of course materials may result in disciplinary measures in accordance with these AGB and, where legally justified, exclusion from further participation. Mandatory statutory rights and legally permitted uses of copyrighted material remain unaffected.

  10. Teaching Staff

    The selection, assignment, and scheduling of teaching staff are determined by Lingua Classica according to academic, pedagogical, organisational, and operational requirements. Students have no entitlement to instruction by a particular teacher, unless Lingua Classica has expressly confirmed the assignment of a specific teacher as a binding contractual commitment. Lingua Classica reserves the right to assign, substitute, or change teachers at any time during a course where reasonably necessary or appropriate, including for reasons of illness, absence, scheduling, staffing, pedagogical considerations, or other operational requirements. More than one teacher may be assigned to the same course or course level. A change or substitution of teaching staff does not, by itself, constitute a cancellation, interruption, or material modification of the booked course and does not entitle the Student to withdraw from the course, suspend or withhold payment, or claim a refund, fee reduction, credit, replacement lessons, extension of the course, damages, or other monetary compensation, provided that Lingua Classica continues to provide instruction of an appropriate standard. Lingua Classica determines the allocation of substitute and replacement teachers. Student preferences concerning particular teachers may be considered but are not binding upon Lingua Classica. Mandatory statutory rights remain unaffected.

D. Academic Integrity.

  1. Principle of Honest Conduct

    Students are required to maintain standards of honesty, integrity, and good faith throughout their participation in courses and in all dealings with Lingua Classica. Students must not engage in cheating, plagiarism, falsification or manipulation of documents, misrepresentation, deception, unauthorised assistance, impersonation, or any other conduct intended to obtain an academic, contractual, administrative, or other improper advantage. This obligation applies to all course-related activities, including lessons, assignments, assessments, examinations, placement tests, attendance records, certificates, applications, communications with Lingua Classica, and documents or information submitted to or issued by the school. Lingua Classica reserves the right to investigate suspected violations and, where a violation is established, to take appropriate and proportionate disciplinary or contractual measures, taking into account the nature, severity, and circumstances of the conduct. Such measures may include a warning, invalidation of affected work or assessments, refusal or withdrawal of certificates or confirmations where legally permissible, suspension, or, in serious or repeated cases, exclusion from further participation or termination of the contractual relationship. Mandatory statutory rights remain unaffected.

  2. Prohibition of Plagiarism and Unauthorized Assistance

    Students must complete assignments, tests, examinations, placement tests, and other assessed work independently to the extent required by Lingua Classica or the respective teacher. Plagiarism, the unauthorised use or reproduction of another person’s work, and the submission of work created wholly or substantially by another person as the Student’s own are prohibited. The use of artificial intelligence tools, automated writing or translation tools, online translators, correction software, external tutoring, third-party assistance, model answers, or other aids is permitted only to the extent expressly allowed for the respective task, assessment, or course. Lingua Classica and its teaching staff may determine which aids are permitted and may require Students to disclose or appropriately identify their use. Students must not obtain, provide, distribute, photograph, reproduce, record, or otherwise make available confidential or non-public examination materials, test questions, answer keys, placement-test content, or other protected assessment materials without authorisation. Students must not allow another person to complete an assessment or other required work on their behalf, nor may they complete such work on behalf of another Student. Impersonation or attempted impersonation in any test, examination, placement procedure, or other assessment is strictly prohibited. Where Lingua Classica has reasonable grounds to suspect plagiarism, unauthorised assistance, impersonation, or other academic misconduct, it may review the relevant work and circumstances and may require the Student to provide an explanation, repeat an assessment, complete an alternative assessment, or otherwise demonstrate that the submitted work reflects the Student’s own language ability. Where a violation is established, Lingua Classica may take appropriate and proportionate measures, including invalidating the affected work or assessment, withholding the corresponding result, requiring reassessment, issuing a warning, or, in serious or repeated cases, suspending or excluding the Student from further participation. Mandatory statutory rights remain unaffected.

  3. Misuse of Certificates and Other School Documents

    Certificates, attendance confirmations, course confirmations, invoices, enrollment confirmations, participation records, and any other official documents issued by Lingua Classica are valid only in the form and with the content in which they were issued by the school. Students must not alter, falsify, manipulate, reproduce for fraudulent purposes, or otherwise misuse any document issued by or bearing the name, logo, signature, stamp, or other identifying features of Lingua Classica. Students must not create or cause to be created any document that falsely appears to have been issued, approved, or authenticated by Lingua Classica. School documents may not be used to represent false or misleading information concerning, in particular, enrollment status, course level, course duration, attendance, participation, examination results, payment status, or completion of a course. Lingua Classica reserves the right to verify the authenticity and accuracy of documents purportedly issued by the school and, where appropriate, to confirm their authenticity or relevant contents to the person, organisation, authority, educational institution, or employer to whom the Student has submitted or authorised the submission of the document, subject to applicable data-protection requirements. Where a document has been issued on the basis of incorrect, incomplete, misleading, or subsequently invalidated information, or contains an administrative error, Lingua Classica may correct, replace, revoke, or withdraw the affected document where legally permissible. Suspected falsification, manipulation, fraudulent use, or other serious misuse of Lingua Classica documents may result in appropriate disciplinary or contractual measures. Lingua Classica also reserves the right, where legally permissible, to take further steps necessary to protect the school, including notifying affected third parties or competent authorities and pursuing available legal remedies. Mandatory statutory rights remain unaffected.

  4. Respectful Conduct Toward Teaching and Learning Environment

    Students are required to behave respectfully and appropriately towards other Students, teachers, employees, contractors, and other persons present at or interacting with Lingua Classica. Conduct that disrupts teaching, interferes with the learning or working environment, threatens the safety, dignity, or wellbeing of others, or materially interferes with the proper operation of the school is prohibited. This includes, in particular, racist, discriminatory, xenophobic, harassing, intimidating, threatening, violent, abusive, or seriously offensive conduct, deliberate disruption of lessons, damage to property, and other serious or repeated misconduct. Discrimination, harassment, or degrading treatment on the basis of race or ethnic origin, nationality, religion or belief, sex, gender, disability, age, sexual identity, or any other legally protected characteristic will not be tolerated. These obligations apply not only on Lingua Classica’s premises and during classroom instruction, but also during online lessons, school-organised activities, and communications or interactions directly connected with the course or the school. Students must comply with reasonable instructions given by Lingua Classica, its teachers, or authorised staff concerning teaching, safety, use of the premises, course organisation, and the maintenance of an orderly learning environment. Where a Student’s conduct breaches these obligations, Lingua Classica may take appropriate and proportionate measures according to the nature and severity of the conduct, including a verbal or written warning, temporary removal from a lesson, reassignment to another group where appropriate, temporary suspension from participation, or, in serious or repeated cases, exclusion from the course or termination of the contractual relationship. Where immediate action is reasonably necessary to protect Students, staff, property, or the proper operation of the school, Lingua Classica may temporarily exclude the Student from the premises or from participation pending clarification of the matter. Exclusion from an individual lesson or other disciplinary action resulting from the Student’s own misconduct does not, by itself, entitle the Student to replacement lessons, an extension of the course, a refund, fee reduction, credit, or other monetary compensation. Lingua Classica reserves the right to take further appropriate action where necessary to protect Students, staff, the school, or its property. Mandatory statutory rights remain unaffected.

  5. Reporting and Enforcement

    Suspected violations of the provisions of this Section or other serious misconduct may be reported to Lingua Classica by Students, teachers, employees, contractors, or other persons concerned. Lingua Classica reserves the right to review and investigate suspected misconduct where there are reasonable grounds to do so. In conducting such a review, Lingua Classica may consider information and evidence reasonably relevant to the matter, including statements from persons involved, course records, attendance records, submitted work, communications, and other available documentation, subject to applicable law. Reports and investigations will be handled with appropriate discretion. Lingua Classica does not guarantee absolute confidentiality where disclosure is reasonably necessary to investigate the matter, protect persons concerned, comply with legal obligations, or exercise or defend legal rights. Before imposing a significant disciplinary measure, the Student concerned will normally be given a reasonable opportunity to respond to the allegations. However, Lingua Classica may take immediate temporary protective or organisational measures where reasonably necessary to protect Students, staff, property, the learning environment, or the proper operation of the school. Where misconduct is established, Lingua Classica may impose appropriate and proportionate measures, taking into account the nature, seriousness, frequency, and circumstances of the conduct. Depending on the circumstances, measures may include a warning, invalidation or repetition of affected academic work, temporary removal from individual lessons, reassignment where appropriate, suspension, exclusion from further participation, or termination of the contractual relationship where legally permissible. The fact that Lingua Classica has previously refrained from taking action in a particular case, or has applied a less severe measure, does not establish an entitlement to the same treatment in another case, provided that applicable legal requirements and the circumstances of the individual case are respected. Where misconduct may involve unlawful conduct or may materially affect the rights, safety, or legitimate interests of Lingua Classica or third parties, Lingua Classica reserves the right, where legally permissible, to inform competent authorities or affected persons and to pursue available legal remedies. Mandatory statutory rights remain unaffected.

E. Student Support and Additional Resources.

  1. Advisory and Information Services

    Lingua Classica may provide Students with general advisory and information services relating to course selection, placement, study planning, language-learning pathways, examinations, and other matters connected with their language studies. Such services are supportive and informational in nature and, unless expressly agreed otherwise in writing, do not constitute separate contractual consulting, legal, immigration, tax, financial, career-placement, or other professional advisory services. Information and recommendations are provided on the basis of the circumstances and information reasonably available to Lingua Classica at the relevant time. While reasonable care is taken to provide accurate and useful information, Lingua Classica does not guarantee that general advice or recommendations will produce a particular academic, professional, administrative, immigration, or examination outcome. Students remain responsible for verifying requirements imposed by third parties, including authorities, embassies or consulates, universities, employers, examination providers, recognition bodies, and other institutions. Where binding or specialist advice is required, Students should obtain information directly from the competent authority or appropriately qualified professional. Decisions concerning course selection, examinations, applications, employment, further education, immigration matters, or other personal or professional matters remain the responsibility of the Student. Mandatory statutory rights remain unaffected.

  2. Learning Materials and Resources

    Lingua Classica may, at its discretion, provide or make available supplementary learning materials and resources in connection with a course, including worksheets, exercises, digital materials, online resources, practice materials, learning platforms, or other educational content. Unless expressly included as part of the booked course, such supplementary materials and resources are additional supportive services and do not constitute an independently guaranteed component of the contractual course programme. Their availability, type, scope, format, and duration of access are determined by Lingua Classica and may vary between courses, groups, teachers, and course levels. The provision of a particular material, resource, platform, or additional learning service at one time does not establish an entitlement to its continued provision, to comparable resources in another course or course period, or to the provision of the same resources to other Students. Lingua Classica may modify, replace, update, restrict, or discontinue supplementary resources where reasonably appropriate for pedagogical, technical, licensing, organisational, or operational reasons. Where access depends on a third-party platform or service provider, Lingua Classica does not guarantee the uninterrupted availability of that third-party service. Unless expressly stated otherwise, Students are responsible for obtaining and bearing the costs of textbooks, workbooks, examination preparation books, software, devices, internet access, or other materials designated as required for their individual course. Materials and resources provided by Lingua Classica or its teaching staff are intended for the Student’s personal educational use. Their reproduction, distribution, publication, commercial exploitation, sharing with unauthorised third parties, or other use in violation of applicable intellectual-property rights or contractual restrictions is prohibited. Temporary unavailability, modification, or discontinuation of a supplementary resource does not, by itself, entitle the Student to a refund, fee reduction, credit, extension, replacement lesson, or other monetary compensation, provided that the essential contractual teaching services continue to be provided. Mandatory statutory rights remain unaffected.

  3. Access to School Premises and Facilities

    Students enrolled in on-site courses may use the classrooms and other areas expressly designated for Student use only at the times and for the purposes authorised by Lingua Classica. Enrollment in a course does not confer a general or unrestricted right of access to the school premises, individual rooms, offices, equipment, or other facilities. Lingua Classica determines the allocation and permitted use of classrooms, common areas, equipment, and other facilities according to operational, organisational, pedagogical, and safety requirements. Students have no entitlement to the use of a particular classroom, room, seat, facility, or item of equipment. Students must comply with reasonable instructions of Lingua Classica, its teachers, employees, or authorised representatives concerning access to and use of the premises. This includes applicable rules concerning safety, hygiene, security, noise, cleanliness, opening and closing times, and the proper use of school property. Lingua Classica may temporarily restrict, modify, or suspend access to particular rooms, facilities, equipment, or parts of the premises where reasonably necessary for operational, organisational, pedagogical, safety, maintenance, repair, security, regulatory, or other legitimate reasons. Where temporary restrictions affect the ordinary classroom allocated to a course, Lingua Classica may provide another suitable classroom or, where reasonably necessary and consistent with these AGB, make another appropriate organisational arrangement. Students have no entitlement to a particular classroom or physical arrangement provided that the essential contractual teaching service continues to be provided appropriately. Students must treat the premises, furniture, technical equipment, teaching equipment, and other property of Lingua Classica and third parties with reasonable care. Students may be held responsible in accordance with applicable law for damage caused intentionally or negligently by them. Access may be refused or withdrawn where a Student materially breaches applicable safety or conduct requirements, misuses the premises or facilities, or where temporary exclusion is otherwise permitted under these AGB. Temporary restriction or unavailability of a particular room, facility, or item of equipment does not, by itself, entitle the Student to a refund, fee reduction, credit, replacement lesson, extension, or other monetary compensation, provided that the essential contractual teaching services can continue to be provided appropriately. Mandatory statutory rights remain unaffected.

  4. Online and Digital Services

    For courses, lessons, or services provided wholly or partly online, Lingua Classica may determine the digital platform, software, communication method, or other technical means used for delivery and may replace or modify such systems where reasonably necessary for technical, organisational, security, pedagogical, or operational reasons. Students are responsible for ensuring that they have suitable and functioning equipment, software, internet access, audio and video capabilities where required, and any other technical requirements reasonably necessary to participate in online instruction. Students are also responsible for familiarising themselves with the basic operation of the platform or software used for the course. Technical difficulties arising from the Student’s own equipment, software, internet connection, settings, accounts, or other circumstances within the Student’s sphere of responsibility do not constitute a failure of performance by Lingua Classica and do not entitle the Student to replacement lessons, an extension of the course, a refund, fee reduction, credit, or other monetary compensation. Lingua Classica will take reasonable measures to provide access to the digital systems and services used for online instruction but does not guarantee uninterrupted or error-free availability of internet connections, third-party platforms, software, hosting services, telecommunications networks, or other technical infrastructure outside its reasonable control. In the event of a technical disruption materially affecting the provision of a scheduled lesson and attributable to Lingua Classica or systems within its reasonable control, Lingua Classica may, at its discretion and where reasonably appropriate, continue the lesson through an alternative platform or communication method, reschedule the affected teaching time, provide a replacement lesson, or make another suitable arrangement. Temporary technical disruptions, changes of platform, or the use of an alternative technically suitable means of instruction do not, by themselves, constitute cancellation or material modification of the booked course and do not give rise to an entitlement to a particular platform, software, or technical method of delivery. Students must comply with reasonable technical, security, access, and usage requirements communicated by Lingua Classica. Login credentials, access links, course passwords, digital classroom invitations, and other access information provided for restricted services may not be shared with unauthorised third parties. Lingua Classica may temporarily restrict or withdraw access to its digital systems where reasonably necessary for security, maintenance, prevention of misuse, protection of other users, or enforcement of these AGB, provided that contractual teaching obligations are appropriately taken into account. Mandatory statutory rights remain unaffected.

  5. Well-Being and Supportive Learning Environment

    Lingua Classica endeavours to provide a respectful, inclusive, and supportive learning environment in which Students can pursue their language-learning objectives. The educational services provided by Lingua Classica do not include medical, psychological, therapeutic, social-work, or comparable professional support services. Teachers, employees, and other representatives of Lingua Classica are not required to assess, diagnose, treat, or assume responsibility for a Student’s physical or psychological condition. Students remain responsible for managing their personal health and well-being and for determining whether they are able to participate in lessons and other course activities. Where professional medical, psychological, or other specialist assistance is required, Students are responsible for obtaining such assistance from an appropriate provider. Where a Student informs Lingua Classica of circumstances that may affect participation in a course, Lingua Classica may, where reasonably practicable, consider appropriate organisational arrangements. Unless required by applicable law or expressly agreed by Lingua Classica, however, this does not create an entitlement to individual supervision, additional teaching, changes to the course structure, a particular teacher or group, replacement lessons, extension of the course, or other individual accommodations. Illness, personal circumstances, stress, workload, or other circumstances within the Student’s personal sphere do not, by themselves, suspend the Student’s contractual obligations or create an entitlement to a refund, fee reduction, credit, replacement lessons, extension, or other monetary compensation. Any voluntary accommodation granted by Lingua Classica in an individual case does not establish an entitlement to the same or comparable accommodation in the future or in other cases. The standards of respectful conduct, non-discrimination, and protection of the learning environment set out elsewhere in these AGB remain applicable. Mandatory statutory rights, including rights to reasonable accommodation where required by applicable law, remain unaffected.

  6. Additional Workshops and Extracurricular Activities

    Lingua Classica may, at its discretion, offer optional workshops, seminars, conversation sessions, examination-preparation activities, cultural activities, excursions, events, or other supplementary or extracurricular services in addition to its regular course programme. Unless expressly included as part of the booked course, such activities are optional supplementary services and do not form part of the contractual teaching obligations of the regular language course. The availability, frequency, content, duration, format, location, and scheduling of such activities are determined by Lingua Classica. Participation may be subject to separate registration, eligibility requirements, minimum or maximum participant numbers, availability of places, additional fees, or other conditions communicated for the respective activity. Enrollment in a regular language course does not create an entitlement to participate in any particular supplementary or extracurricular activity. Lingua Classica reserves the right to modify, postpone, combine, relocate, change the format of, or cancel an optional activity for organisational, operational, pedagogical, staffing, safety, participant-number, or other legitimate reasons. Where a separately charged optional activity is cancelled by Lingua Classica and no suitable alternative is provided or accepted, fees paid specifically for that cancelled activity will be refunded. Cancellation or modification of an optional activity does not affect the validity, duration, or fees of the Student’s regular language-course contract. Where an optional activity is provided free of charge, its cancellation, modification, postponement, or discontinuation does not entitle the Student to a refund, fee reduction, credit, replacement service, extension of the regular course, or other monetary compensation. The provision of a particular workshop, activity, event, or other supplementary service on one or more occasions does not establish an entitlement to its continued or repeated provision, whether during the same course or in any subsequent course. Lingua Classica may establish reasonable rules concerning participation, safety, conduct, age, capacity, registration deadlines, or other organisational requirements for individual activities and may refuse or restrict participation where such requirements are not met. Mandatory statutory rights remain unaffected.

F. Cancellation Policy – Lingua Classica.

  1. Right of Withdrawal (Fernabsatzrecht):

    In accordance with §§ 312g, 355, and 356 BGB, consumers have the statutory right to withdraw from a distance contract within fourteen (14) days of its conclusion, without giving any reason. The withdrawal period begins on the day the contract is concluded. To exercise this right, the Student must notify Lingua Classica in writing (e.g., by email or letter) within the withdrawal period. However, this right may be restricted in certain circumstances: (a) if the Student has expressly requested Lingua Classica to begin providing services (such as preparing enrollment confirmations, invoices, or visa support documents) before the withdrawal period has expired, and (b) if the service has already been fully provided. In such cases, pursuant to § 356 Abs. 4 BGB, the right of withdrawal may expire earlier, or Lingua Classica may deduct reasonable compensation for the services already rendered under § 357 Abs. 8 BGB.

  2. Visa-Related Cancellations after Withdrawal Period

    For Students requiring visas, refunds after the expiry of the statutory withdrawal period are possible only in the event of an official visa refusal. The Student must provide the original refusal letter issued by the competent German embassy or consulate, submitted no later than ten (10) business days before the confirmed course start date. If these requirements are met, tuition fees will be refunded minus a €499 administrative fee to cover the preparation and processing of enrollment documents, as recognized under § 346 BGB. If the refusal letter is submitted late or not provided at all, no refund is available. This rule is intended to balance the Student’s interests with Lingua Classica’s obligation to reserve teaching resources and comply with legal documentation duties. It corresponds directly with Section A.2 (Visa-Specific Refunds).

  3. Non-Visa Cancellations after Withdrawal Period

    For Students who do not require a visa, or who have already exercised or waived their statutory right of withdrawal, cancellation requests must be submitted in writing no later than fourteen (14) calendar days before the scheduled course start date. This deadline ensures that Lingua Classica can maintain fair scheduling, allocate teachers and classrooms appropriately, and manage limited course capacities in a transparent manner. Cancellations received after this deadline or once the course has commenced do not entitle the Student to any refund, credit, or release from payment obligations, pursuant to § 615 BGB (continued obligation to pay despite non-attendance) and § 307 BGB (reasonable risk allocation). By enrolling, Students expressly acknowledge and agree that each course represents a fixed-term educational service with reserved teaching and administrative resources. The School’s contractual obligations are fulfilled once the course begins, regardless of the Student’s subsequent participation. In exceptional cases, Lingua Classica may, at its sole discretion, review written requests for postponement or partial credit on compassionate grounds (e.g. serious illness supported by documentation). Such gestures, if granted, are purely voluntary and do not establish any recurring entitlement or legal precedent.

  4. No-Show and Early Withdrawal

    Failure to attend classes (no-show) or withdrawal after the course has already commenced does not entitle the Student to cancellation or refund of fees. The full invoiced tuition remains payable, as Lingua Classica has fulfilled its contractual duty to provide the agreed instruction. This principle is anchored in § 615 Satz 1 BGB, which stipulates that the debtor (Student) remains obligated to pay even if they do not take advantage of services offered. Any exceptions must be expressly agreed upon in writing, and Lingua Classica may, at its sole discretion, offer goodwill arrangements without creating a legal entitlement to such measures in the future.

  5. School-Initiated Cancellations

    If Lingua Classica cancels a course before commencement due to insufficient enrollment (fewer than four Students, see Section C.2) or due to impossibility of performance under § 275 BGB (e.g., force majeure, sudden unavailability of qualified instructors), Students are entitled to a full refund of all fees paid. The school may retain an administrative fee of up to €50 in accordance with § 346 BGB. Students will be informed of such cancellations promptly and in writing. No claims for damages, consequential losses, or additional compensation may be asserted against Lingua Classica, except in cases of gross negligence or willful misconduct under § 276 BGB. This ensures a balanced allocation of risk between the Student and the school.

G. Legal Provisions.

  1. Applicable Law and Jurisdiction (§§ 12, 29, 38 ZPO; Art. 6 Rome I Regulation)

    All contracts between Lingua Classica and the Student are subject exclusively to the laws of the Federal Republic of Germany. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. For Students who are consumers within the meaning of § 13 BGB, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of their habitual residence (Art. 6 Rome I). The place of performance for all obligations arising from the contractual relationship is Bielefeld, Germany, unless otherwise agreed in writing. If the Student is a merchant (§ 14 BGB), a legal entity under public law, or has no general place of jurisdiction within Germany, the exclusive place of jurisdiction shall be Bielefeld (§ 38 ZPO). Lingua Classica nevertheless reserves the right to sue the Student at their general place of jurisdiction.

  2. Conclusion of Contract and Contractual Language (§§ 145 ff. BGB)

    Contracts are concluded in accordance with the rules set out in Section A (General Information). A binding contractual offer is submitted by the Student when they complete the online enrollment form and confirm via the “Zahlungspflichtig buchen / Confirm Enrollment – Payment Required” button (§ 312j BGB). Lingua Classica accepts this offer by sending an explicit written confirmation of enrollment, which may be issued electronically. In the case of on-site enrollment, the contract is concluded by the signature of the physical enrollment form. The contractual language is German, and any translations of these Terms are provided solely for convenience. In case of discrepancies or disputes over interpretation, the German-language version shall prevail in all respects.

  3. Force Majeure (§ 275 BGB)

    Lingua Classica shall not be liable for delays, disruptions, or non-performance resulting from events beyond its reasonable control (“force majeure”). Such events include, but are not limited to, natural disasters, pandemics, epidemics, government-imposed restrictions, strikes, lockouts, significant disruptions to internet or telecommunication networks, or the unavailability of teaching staff due to illness when no adequate replacement can be arranged. In cases of temporary impossibility (§ 275 (1) BGB), the duty to perform is suspended for the duration of the impediment. If the impediment persists for more than sixty (60) days, both parties are entitled to withdraw from the contract in writing. Payments already made for services not rendered will be refunded in such cases, but Students have no right to claim damages or additional compensation beyond reimbursement, unless Lingua Classica acted with gross negligence or intent. This provision ensures both fairness and legal certainty in extraordinary situations.

  4. Limitation of Liability (§§ 276, 309 No. 7 BGB)

    Lingua Classica is liable without limitation for damages resulting from intent and gross negligence, as well as for injury to life, body, or health. For damages caused by simple negligence, liability exists only if a material contractual obligation (Kardinalpflicht) has been breached. In such cases, liability is limited to the foreseeable damage typical for this type of contract. Kardinalpflichten are those duties that are essential for the proper performance of the contract and upon which the Student may regularly rely. Liability for indirect or consequential damages, such as lost profits or missed opportunities, is excluded except in cases of intent or gross negligence. This allocation of risk corresponds to the statutory framework under §§ 276 and 309 No. 7 BGB and ensures that Lingua Classica is accountable for significant breaches but not exposed to disproportionate liability.

  5. Severability Clause (§ 139 BGB)

    If any provision of these Terms is or becomes invalid, illegal, or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a legally permissible regulation shall apply that comes closest to the intended economic purpose of the invalid provision (§ 139 BGB). The same applies in the event of a contractual gap. This ensures that the contract remains effective as a whole, protecting the interests of both Lingua Classica and the Student. By agreeing to these Terms, the Student expressly waives the right to challenge the entire contract solely because of the invalidity of a single clause.

  6. Written Form Requirement (§ 126 BGB)

    All amendments, supplements, or ancillary agreements to these Terms and Conditions must be made in writing to be effective. This requirement also applies to the waiver of the written form itself. Written form is deemed satisfied if the declaration is transmitted by email, provided the sender can be clearly identified and the text is permanently reproducible. Oral collateral agreements are invalid unless subsequently confirmed in writing by Lingua Classica. This rule ensures clarity, transparency, and evidence security for both parties in the contractual relationship.

Statutory 14-day Withdrawal Period

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Zabelina, Elena und Das, Tanmay Kumar GbR, Bahnhofstraße 42, 33602 Bielefeld, Germany, ‪+49 15750950617‬, info@linguaclassica.de) by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, which is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we must return to you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive the notification of your withdrawal from this contract.

For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees for this repayment.

If you requested that the services begin during the withdrawal period, you shall pay us an appropriate amount corresponding to the proportion of the services already provided up to the time at which you informed us of the exercise of the right of withdrawal, in comparison with the total scope of the services provided for in the contract.

Expiry of the Right of Withdrawal

Your right of withdrawal will expire prematurely if we have fully performed the service and only if we started to perform the service after you gave us your express consent and at the same time confirmed your knowledge that you would lose your right of withdrawal once the contract has been fully performed by us.
